1. In General Offers, deliveries and all kind of services are
subject to the following business and delivery conditions which you accept when
ordering with us. By visiting us, you agree that the laws of the Federal
Republic of Germany will govern the conditions of use. The offer is always
subject to alteration. We refer to our right to our authorization of
disposition. As our products are no mass-produced articles, small alterations
from our description and reproductions might occur.
2. Prices The date of reception of
your order is authoritative for the price which includes the VAT. Anytime we
can alter our prices. With the date of the publication of the recent price list
all former price lists are no longer valid.
Prices are always in Euros.
3. Costs for Postage and Packing See shop and check-out.
4. Delivery Place of fulfillment is Höxter. Shipment can only be
carried out after having received the advance payment or in exceptional cases
on the basis of an invoice (Pay Pal). The risk is with the purchaser. All items
purchased from PK-PRO are made pursuant to a shipment contract. This means, the
risk for of loss and title for those items pass to the purchaser upon delivery
to the carrier.
5. Conditions of Payment If no other agreements have been made, the amount of
the invoice has to be paid within a period of 14 days after receipt of the
invoice. If we do not receive the payment within this period the order will be
cancelled.
We can only accept Euros as currency. The customer has to pay the change.
6. Reservation of Proprietary Rights Delivered items remain our property according to § 455
BGB, until the receipt of payment.
7. Damage due to Transportation Is the packing undamaged and damages are only
discovered after unwrapping the purchased items, the buyer has to query within
the next three days after having received the delivery with the carrier. He
also has to contact PK-PRO. If there are obvious damages at the packing, the
buyer has to query right away with the carrier and get in contact with us. In
any case, the delivery should remain in the condition in which it was
delivered. Please do in any case get in contact with us. Damages subject to
inappropriate handling are not subject to the responsibility of PK-PRO!
8. Returns Policy The buyer is entitled to return items with defects
within 10 days after receipt of the delivery. In accordance with our
consideration we either remove the defects or send a substitute delivery or
issue a credit note. The costs of the return shipment pass to us when the
reclamation is legitimate. Otherwise the costs pass to the buyer. Please make
sure that the returned items are packed in an appropriate manner and that we
get a written statement of the reasons for the return.
9. Privacy Any and all information collected on our site or
through our email contact will be kept strictly confidential. All data are kept
and processed according to the necessity for the business and according to the Federal
Laws for Data Protection -§ 26, BDSG- and the Teledienstdatenschutzgesetzes
-TDDSG- of German
We use your inventory data exclusive for the
completion of your order. All customer data is stored and processed considering
the relevant regulations by us. You have at any time a right to access,
correction, block and deletion of your stored data or information. We do not
pass on any of your personal data including your Postal address and E-Mail
address without your express and at any time revocable consent to third
parties.
10. Court Jurisdiction Court jurisdiction is for both parts Höxter,
Germany.
Only in accordance with our consideration prosecution against the buyer can be
held at the buyer’s court.
11. Others The ineffectiveness of some regulations does not
affect the validity of these Terms of business.
Cancellation You are not any more bound to your order, if you send
back the ordered items within a period of ten days after having received the
shipment. Please confirm your cancellation in a written way, either with an
email or a letter. Already used or damaged items (except for damages due to
transportation) are not refundable. You can avoid such damages by leaving the
items in their original package.
